Since May 2016, a new Decree in Andalucían law regulates properties offered as holiday rentals. Failure to follow these laws means risking getting fines starting from 2000€ and going up to 150 000€.
We at Lula Homes understand that the regulations sometimes can feel overwhelming, but we are here for you!
Tourist Licence
Firstly, when renting out your home as a holiday rental, it is mandatory to withhold a tourist license for the property. When applying for a tourist license, you must provide a document, such as the Cadastral Reference, to prove your ownership of the property and a photocopy of your DNI, NIE, or CIF. Lula Homes has connections with reliable lawyers if you need help applying for a tourist license.
Taxes
You pay your holiday rental income taxes with your tourist license number every quarter. The percentage of the tax depends on if your tax liability is in a European country, non- European country, or if you are a Spanish resident. The income you make from your holiday rental is taxed in Spain, even if your tax liability lies in another country. Fortunately, you can deduct the following from your tourist tax base:
IBI and rubbish local tax
Community fee
Water, gas, and electricity consumption
Internet
Insurance
Agency fees
Loan/ Morgage
What your rental needs to offer

Refrigeration A/C during summer months

In addition to the above, the law covers that you must pass the ID details of every guest over 16 to the Local Police Office. You also need to obtain a rental contract signed by every guest, and it must be archived together with the ID details for a year
