[5] The object behind enacting the TPP Act was to improve public health by discouraging people from taking up smoking.[6] To achieve this, as per the Act, the plain packaging helps reduce the appeal of tobacco products, increases the space for health warnings on the products and reduces the ability of the packaging to mislead consumers about the harmful effects of smoking.[7] In 2012, the constitutionality of the TPP Act came to be challenged before the High Court of Australia by four tobacco giants, namely British American Tobacco, Philip Morris, Imperial Tobacco and Japan Tobacco
